Article 1. Application of Conditions

These General Conditions of Sale apply to sales concluded between, on the one hand, any adult resident in Metropolitan France making a purchase through the online sales site www.unigreen.fr and, on the other hand, SASU Unigreen.
Therefore, they apply automatically to all orders placed on the website www.unigreen.fr, the exclusive property of SASU Unigreen, and whose Publication Director is Ms. Maryève Berthelot, President and CEO.

Article 2. Products

The product offers offered on the www.unigreen.fr site are governed by these conditions of sale; they are valid as long as they remain online until exhaustion of their availability.
The products offered for sale on the site www.unigreen.fr are described with the greatest possible accuracy.

Article 3. Order

Any order placed on the site www.unigreen.fr implies express acceptance of these General Conditions of Sale and implies acceptance of the prices and products available for sale.

Order process:
The customer who wishes to place an order must follow the following procedure:

Choice of product: The customer selects the product he wishes to order;

Verification of the content of the selection: The customer verifies the content of his basket while retaining the possibility of deleting the selected products;

Identification: The customer fills in the identification form made available to him and indicates the requested information (compulsory information: title, surname, first name, billing address, delivery address, date of birth, e-mail, password, telephone number for delivery);

Verification of the order: The customer verifies the content of his order, the total price, the delivery and billing addresses while retaining the possibility of deleting a product or modifying the billing and delivery address.

Choice of payment method: The customer chooses the payment method (as defined in article 4).

Choice of delivery methods: By SoColissimo to the address that will be indicated by the customer (home, relay point, post office, locker in Paris) via the drop-down menu offered on the site or in the UNIGREEN shop chosen by the customer.

Confirmation of the order: The customer confirms his order by accepting these general conditions of sale by checking the corresponding box. The validation of the order is only possible after having checked this box;

Return to the Bank's site for secure payment (SSL): The customer indicates the bank details necessary for payment and corresponding to the chosen method of payment. His account will be debited within 6 days of ordering;

Acknowledgment of receipt of the order: The customer receives an e-mail summarizing the content of your order, namely:
- the number of his order;
- the list of products ordered;
- delivery terms
- payment terms

This document being the official proof of the order, the customer must keep it.
Order processing: The order is then recorded and processed by SASU Unigreen which checks the availability of the product (s) ordered.
SASU Unigreen undertakes to honor orders received on its website. SASU Unigreen will contact the customer by email as soon as possible, in order to prevent the cancellation or refund of the order.

Order confirmation:
If the customer has paid by bank card or bank transfer, the customer will receive an e-mail confirming that the order has been sent. The contract is deemed to be concluded on the date of sending this e-mail
If the customer pays for the cash on delivery option, the customer will receive an email confirming that he has sent his order, he / she will be contacted directly to organize the meeting. During this meeting, the articles will be delivered to the customer for cash. cash or check. The contract is deemed to have been concluded on this date.

Article 4. Price - Terms of payment and security - retention of title clause
The prices charged are those in force on the day of the order. All prices are indicated in euros, VAT included (VAT included), excluding participation in preparation and delivery costs, as defined in article 5 below.
- The delivery costs will be mentioned in the "basket" during the validation of the order.
SASU Unigreen reserves the right to modify its prices at any time but the products are invoiced on the basis of the prices in force at the time of the validation of the order by the customer.

Payment terms :

- By bank card (Visa, CB, Mastercard): in this case, payment is made on the Stripe site. This implies that no banking information concerning the customer passes through the site www.unigreen.fr.
Payment by credit card is therefore perfectly secure (SSL). Your bank will ask for authentication before confirming payment. The order will be recorded and validated upon acceptance of payment by the banking service.
- By bank transfer in this case, the customer transfers the money to Unigreen with the following IBAN: FR22 2004 1010 1114 5880 8V03 291. Upon receipt of the amount we will prepare and send your order if you have opted for home delivery. The order will be recorded and validated upon receipt of the amount on the bank account of SASU Unigreen.
Security:

The details of the bank card used are encrypted using the SSL (Secure Socket Layer) protocol and never pass unencrypted over the network. Payment is made directly to Stripe. SASU Unigreen has no access to these coordinates and does not keep them on its servers.

Title retention clause :
The products remain the property of SASU Unigreen until full collection of the price by SASU Unigreen. However, from delivery, the risks of the goods delivered are transferred to the customer.

Failure to pay:
SASU Unigreen reserves the right to refuse to make a delivery or to honor an order from a customer with whom a payment dispute is being administered.

Anti-fraud controls:
In order to ensure the security of transactions and to respond to the concern of the greatest number of people to prevent fraud in the area of distance selling, SASU Unigreen. performs checks on orders that have been validated on its online sales site www.unigreen.fr. These controls are designed to protect SASU Unigreen from abusive remote payment practices. As part of these control procedures, SASU Unigreen may be required to ask the customer to transmit documents necessary for the release of his order: proof of identity, address, debit in your name, etc. The goal is to ensure the reality of identity and domiciliation.

Article 5. Delivery methods
General:
Products purchased on www.unigreen.fr are delivered only in mainland France. The products are delivered to the delivery address indicated during the ordering process. The delivery times indicated are average times and correspond to the times of processing, preparation and routing of the order.

Shipping fees :
For deliveries in mainland France, the preparation and shipping costs are in proportion to the weight of the items ordered.
The preparation and shipping costs will be indicated on the summary of the customer's order before validation thereof. This amount will be due in addition to the price of the products purchased.

Delivery time :
For all products, the order is prepared for departure from our warehouses within a maximum of 72 working hours (subject to availability of stocks) from the confirmation by e-mail of the order. Delivery is then made by carrier (So Colissimo - La Poste) within a maximum of 3 working days.
The time between an order and its delivery is 5 working days, outside of sales periods, and 15 working days during the end of year periods and commercial sales.
This is a delay depending on the destination and the availability of the product ordered. Exceeding this deadline may not give rise to any cancellation of the order, to any reduction in the price paid by the buyer, and to any payment by way of damages.

However, and in accordance with the provisions of articles L.221-11 and following of the Consumer Code, failure to deliver at the expiration of a period of thirty days from the next day when the customer placed his order, he will have the possibility of canceling the order without charge. The sums which have been withdrawn from him will be refunded to him.

Delivery and complaints:

Only deliveries in mainland France are possible. Packages are shipped via So Colissimo.

Delivery via So Colissimo - Domicile is made to the delivery address indicated by the customer in the order process. In the absence of the recipient at the time of delivery, as part of the delivery by the carrier, the delivery person will leave a notice in the recipient's mailbox. The latter must then come and collect it at the address specified on the calling card (post office).

In the event of an incomplete address, wrong address, refusal of the parcel by the recipient or lack of information resulting in an impossibility of delivering the product to the recipient in due time, SASU Unigreen cannot be held responsible for quality final of this delivery. Receipt of order :

Upon receipt of the order, the customer will verify the conformity of the products received in execution of his order. Unless there are legitimate reasons, any complaint made beyond the 14 days following receipt of the products will be considered inadmissible and SASU Unigreen cannot be held liable.
SASU Unigreen reserves the right to ask the customer to return the non-conforming or damaged product to him.


Article 6. Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the last item.
Exercising the right of withdrawal: To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example, letter sent by post, fax or email) by mail to address:

For the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period.
You will have to bear the direct costs of returning the goods.


Consequences of the right of withdrawal

You must return or return the goods to SASU Unigreen - web service, 6 RUE YVES MARIE, 44100 NANTES without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from the this contract.

This deadline is deemed to be respected if you return the goods before the expiration of the period of fourteen days.


In the event of your withdrawal from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen, if applicable, a method of delivery other than the less expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract.

We will reimburse using the same means of payment as that which you used for the initial transaction, unless you expressly agree to a different means; in any event, this reimbursement will not incur any costs for you.

We can postpone the reimbursement until we have received the goods or until you have provided proof of shipment of the goods, whichever is the earlier.

Your responsibility is engaged only with regard to the depreciation of the good resulting from manipulations other than those necessary to establish the nature, the characteristics and the good functioning of this good.

Exception to the right of withdrawal

The exercise of the right of withdrawal is excluded for the following contracts:

- contracts for the supply of goods made up to the consumer's specifications or clearly personalized;

- contracts for the supply of goods liable to deteriorate or expire quickly;

- contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

- contracts for the supply of goods which, after having been delivered, and by their nature, are inseparably mixed with other articles;

- contracts for the supply of goods or services whose price depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period.

Article 7. Non satisfaction

In the event of dissatisfaction with his purchase, the customer has 15 days from the date of receipt at home or withdrawal of the package to return the item (s) to us to claim the exchange or refund of his purchase, using the procedure attached to the package.

Exchange procedure:
Exchanges are only possible on the same reference, if the item arrives non-compliant with the commercial description. The customer must then inform the reception of the exchange request and have photographic evidence for the exchange of the product.
SASU unigreen reserves the right to refuse or accept the exchange and will propose, if necessary, a new shipment of items.
Subject to compliance with the conditions indicated below, SASU Unigreen will exchange the returned ordered products within fifteen (15) days of receipt by SASU Unigreen of the products.

Return for refund:
Remember to attach to your shipment, the copy of the order confirmation email.
The reimbursement of your order will be made within 10 to 15 days following the date of receipt of your package by our logistics.
You will receive an email giving you the date of the refund validated in bank or via PayPal.
Any item returned incomplete, damaged or without its original packaging and without its label cannot be exchanged or refunded. Unigreen reserves the right to refuse the return in the event of non-compliant or abusive returns.

Article 8. Guarantee
The products sold benefit from legal guarantees provided that the use has been normal and that the maintenance advice has been followed.
Article L217-4 of the Consumer Code: The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility.

Article L217-12 of the Consumer Code: The action resulting from the lack of conformity lapses two years after delivery of the goods.
Article 1641 of the civil code: The seller is bound by the guarantee for hidden defects in the thing sold which makes it unfit for the use for which it is intended, or which so diminishes this use, that the buyer would not have it not acquired, or would have given a lesser price, if he had known them.
Article 1648 paragraph 1 of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.
This warranty does not cover damage resulting from misuse of the product or normal wear and tear due to its use. To be able to benefit from the product warranty, it is imperative to keep the purchase invoice for the product as well as the delivery slip.

Article 9. IT provisions and freedoms

Article 13. Applicable law - Disputes

SASU Unigreen is a company incorporated under French law. The law applicable to our contractual relations is French law. In the event of a dispute, the French courts will have jurisdiction.
